Photography contract include detailed information on fees, including the payment schedule and any additional costs. I also include information on the policies regarding cancellations, rescheduling, and refunds, as well as our copyright and usage policies. The goal is to ensure that the clients feel confident and comfortable working with New Saga Pictures and that they have a clear understanding of what they can expect from the services.

Contract Terms

The client and Photographer agree that the Photographer will provide photography service as outlined in the tables below. This contract represents the entire understanding of the requirements, schedule, and payment terms for the services listed in this contract. Clients accept sole financial responsibility for any fees or related costs incurred by the Photographer in enforcing the terms of this contract. Any failure by one or both parties to uphold or enforce a provision of this contract shall not constitute a waiver of any other provision of this contract.

By registering for the photoshoot with New Saga Pictures, you agree to the following terms and conditions;

Photoshoot is registered and there is a contract between the client and New Saga Pictures once a full payment is made for a particular package and date. New Saga Pictures will not be liable for default for circumstances beyond New Saga Pictures control, such as poor weather, non‐performance of environmental conditions, travel delays, or other similar factors.

General terms and conditions applying to photoshoot

New Saga Pictures is not responsible for any other costs which a photoshoot may have incurred for the client, including but not limited to travel, photographic purchases and/or rentals.

New Saga Pictures accepts no liability for illness, death or injury or loss or damage to photo equipment or personal belongings during the photoshoot or in transit there to. New Saga Pictures accept no responsibility for losses or additional expenses due to delay or changes in the services to be provided. New Saga Pictures reserve the right to change arrangements should conditions necessitate, or to cancel any aspect of the photoshoot due to exceptional circumstances. In the event that New Saga Pictures deem it necessary to cancel the photoshoot, New Saga Pictures will provide a full refund, which the client acknowledge as full and final settlement.

New Saga Pictures will assume no liability for injury, illness or loss of personal property or expenses associated with participation in the photoshoot.

Booking acceptance

Full payment is required at the time of booking. New Saga Pictures will confirm acceptance of client booking by email. At the time that New Saga Pictures send out the confirmation that a contract comes into existence. New Saga Pictures reserve the right to refuse any booking without giving a reason. Failure to sign a waiver will result in the client’s booking being treated as having been cancelled and New Saga Pictures reserve the right to impose the cancellation fees described in this agreement. 

Cancellation Policy

In the event that New Saga Pictures deem it necessary to cancel the photoshoot, New Saga Pictures will provide a full refund which the client(s) acknowledges as full and final settlement.

Cancellation of a client’s booking must be notified in writing to New Saga Pictures. If client needs to cancel up to two weeks prior to the photoshoot, then a 50% refund will be issued. And if client cancel less than two weeks before the photoshoot start date, client will receive a 25% refund. If client cancel less than one week beforehand, you will receive no refund. All cancellations must be made in writing, emails are acceptable. The date on which the letter or email is received by New Saga Pictures, will determine the rates of cancellation charges applicable. In the case of a cancellation from New Saga Pictures end, a full refund will be given.

Client may reschedule the date of the photo shoot with the written approval of the Photographer. Should the Photographer be unable to accommodate the Client's rescheduled date, the Client will not be held responsible for the remaining balance of this contract.

Pricing

Any additional goods or services not included in this photography contract will be sold at then-current rates. Photographer makes no pricing guarantees outside of the terms of this contract, and the Client acknowledges that prices for additional goods or services are subject to change suddenly and without notice.

Responsibilities

New Saga Pictures will be the sole and exclusive photographer for the photoshoot. Photographer is responsible for bringing any equipment or assistant’s necessary to conduct the services outlined in this contract. Client agrees to prevent any other photographers at the shoot listed in this contract from interfering with the Photographer's performance of their duties.

This includes guests and other amateur photographer. Photographer is not responsible for degraded coverage due to environmental issues, such as poor event lighting, space, or backdrops. Photographer agrees to make every effort to provide satisfactory coverage, but cannot make any guarantees as to specific photos, poses, etc. during the event.

Image Processing 

When the Client requests a digital copy of their images, the Photographer will provide one image set: corrected/retouched copies. Photographer is not responsible for the printed copies of images delivered to the Client as electronic files.

Unauthorized Reproduction

Client agrees not to reproduce or modify the images or footage provided by the Photographer without first obtaining a formal written release signed by the Photographer. Should the Photographer discover any violations to this agreement, the Client agrees to be held financially responsible at a rate of €60 per violation.
